1. Scope and who we are

This Privacy Policy explains how Alliance Optimal, LLC, a New Mexico limited liability company ("Alliance Optimal," "we," "us," or "our"), collects, uses, shares, and protects personal information in connection with allianceoptimal.com and any page that links to this Privacy Policy (together, the "Site").

This Privacy Policy applies only to the Site. It does not apply to information we process when we provide services to a client under a separate written agreement, which is governed by that agreement, or to any third-party website, product, or service, even if you reach it through a link on the Site.

By using the Site, you acknowledge that you have read this Privacy Policy. Your use of the Site is also governed by our Terms of Use.

2. Information we collect

Information you provide to us

When you use the contact form on the Site, we collect your name, your email address, your company name (optional), and the contents of your message. The form also contains a hidden field that people do not see and should leave empty; it helps us filter automated spam. If you email us directly, we collect your email address, the contents of your message, and anything else you choose to include.

Please do not send us sensitive personal information (for example, government identification numbers, financial account details, health information, or passwords) through the contact form or by email. We do not request it and do not need it to respond to an inquiry.

Information collected automatically

When you visit the Site, certain information is collected automatically by our hosting provider and by the tools described in this Privacy Policy, including:

  • Server and request data: your IP address, browser type and user agent, device and operating system type, the page or resource requested, the referring page, the date and time of the request, and response and error data. Our hosting provider, Vercel, records this data in server and security logs when it delivers the Site to you.
  • Site analytics: we use Vercel Web Analytics to understand how the Site is used in aggregate, such as which pages are viewed, referring sites, approximate location at the country level derived from IP address, and browser, device, and operating system type. Vercel Web Analytics does not use cookies. It distinguishes visits using a hash of request data that Vercel describes as resetting daily, and we view the results in aggregate.
  • Performance data: we use Vercel Speed Insights to measure how quickly pages load and respond, which collects page URLs, performance measurements, and general device and connection information.
  • Cookies and similar technologies: the Google Ads tag on the Site sets cookies and uses similar identifiers, as described in Section 6.

Information from Google advertising

When you reach the Site by clicking one of our advertisements, Google may pass us a click identifier and related campaign information. Google also provides us with reports about the performance of our advertising, such as the number of clicks and conversions. These reports are aggregated and do not identify you by name.

3. How we use information

We use the information described above to:

  • respond to your inquiry, communicate with you, and evaluate whether and how we might work together;
  • operate, host, maintain, secure, and improve the Site, including diagnosing technical problems and measuring performance;
  • understand how visitors find and use the Site;
  • measure the effectiveness of our advertising, including counting ad clicks and contact form submissions that follow them, and show our advertisements to people who have visited the Site;
  • detect, prevent, and respond to spam, fraud, abuse, security incidents, and other harmful or unlawful activity;
  • comply with legal obligations, respond to lawful requests, and establish, exercise, or defend legal claims; and
  • carry out any other purpose that we describe to you when we collect the information, or with your consent.

We may also create aggregated or de-identified information that does not reasonably identify you and use it for any lawful purpose. Where we maintain de-identified information, we will not attempt to re-identify it except as permitted by law.

4. Legal bases for visitors in the EEA and UK

The Site is operated from the United States and is directed primarily to visitors in the United States. If the European Union General Data Protection Regulation, the United Kingdom General Data Protection Regulation, or a similar law applies to our processing of your personal information, we rely on the following legal bases:

  • Legitimate interests: to respond to inquiries and discuss potential engagements, to operate, secure, and improve the Site, to understand Site usage in aggregate, to prevent spam and abuse, and to protect our legal rights. We rely on these interests only where they are not overridden by your interests and fundamental rights.
  • Steps prior to entering into a contract: where you contact us about a possible engagement, we process your information to take steps at your request before entering into a contract.
  • Consent: where the law of your location requires consent for cookies or similar technologies used for advertising, our legal basis for that processing is your consent. You may withdraw consent at any time using the controls described in Section 6, without affecting the lawfulness of processing before withdrawal.
  • Legal obligation: where we must process information to comply with the law.

5. How we share information

We share personal information only as described below:

  • Service providers: companies that perform services for us, including Vercel (website hosting, content delivery, server logs, Web Analytics, and Speed Insights) and our email service providers, which transmit and store contact form submissions and email correspondence. These providers may use the information only as needed to provide their services to us or as their terms permit.
  • Google advertising: the Google Ads tag on the Site sends Google information such as your IP address, browser and device information, the pages you visit on the Site, cookie and similar identifiers, ad click identifiers, and the fact that a contact form was successfully submitted. Google uses this information to measure our advertising, to build audience lists so that we can show our ads to people who have visited the Site, and for its own purposes as described in How Google uses information from sites or apps that use its services. We do not send Google your name, email address, company, or the contents of your message.
  • Professional advisers: our legal counsel, accountants, auditors, insurers, and other professional advisers, where necessary for them to advise us.
  • Legal compliance and protection: law enforcement, regulators, courts, or other parties when we believe in good faith that disclosure is required by law or legal process, or is necessary to protect the rights, property, or safety of Alliance Optimal, our clients, you, or others, or to investigate or prevent fraud, abuse, or security issues.
  • Business transfers: a buyer, successor, or other party, and their advisers, in connection with an actual or proposed merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, in which case personal information may be transferred as one of our business assets.
  • With your direction or consent: any other party when you direct us to share the information or consent to the sharing.

We do not sell personal information for money. However, some US state privacy laws define "sale," "sharing," or "targeted advertising" broadly enough to include allowing an advertising partner such as Google to collect information through cookies and similar technologies on a website for advertising purposes. To the extent those definitions apply to our use of the Google Ads tag, you may opt out as described in Sections 6 and 9.

6. Cookies, advertising, and your choices

Cookies are small text files placed on your device by a website. Similar technologies include pixels, tags, local storage, and device identifiers.

We use the Google Ads tag (gtag.js) on every page of the Site. It sets cookies and uses similar identifiers to:

  • measure when someone who clicked one of our ads visits the Site;
  • record a "contact form lead" conversion when a contact form is successfully submitted; and
  • support remarketing and audience lists, which allow us to show our advertisements to people who have previously visited the Site when they use Google services or websites in Google's advertising network.

We do not use Google's enhanced conversions feature, which means we do not send Google your email address or other contact details from the form.

The Site's fonts are hosted on our own servers, so loading them does not send your information to a font provider. Vercel Web Analytics and Speed Insights, described in Section 2, do not set cookies.

Your choices

  • Google ad settings: you can turn off personalized advertising from Google at adssettings.google.com.
  • Industry opt-outs: you can opt out of interest-based advertising from participating companies through the Network Advertising Initiative at optout.networkadvertising.org and the Digital Advertising Alliance at optout.aboutads.info.
  • Browser controls: most browsers let you block or delete cookies, including third-party cookies. If you block cookies, the Site will still work.
  • Global Privacy Control: where applicable law requires us to do so, we treat a Global Privacy Control (GPC) signal sent by your browser as a valid request to opt out of targeted advertising and of the "sale" or "sharing" of personal information for that browser.

Opt-outs are generally specific to the browser and device you use, and may stop working if you delete your cookies. Opting out of personalized advertising does not mean you will stop seeing ads; it means the ads you see may be less relevant to you. Some browsers offer a "Do Not Track" setting. Because there is no common industry standard for interpreting it, the Site does not respond to Do Not Track signals, but GPC signals are handled as described above.

7. How long we keep information

We keep personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to respond to you, to maintain business records, to resolve disputes, to enforce our agreements, and to comply with legal obligations. In particular:

  • Contact inquiries and related correspondence are kept for up to three years after our last communication with you, unless the inquiry leads to a client engagement, in which case the records are kept as long as needed for that engagement and as required by our agreement with the client and by law.
  • Server and hosting logs, analytics, and performance data are kept according to the default retention periods of Vercel.
  • Advertising data collected by Google is kept according to Google's retention practices and the settings of our advertising account.

We may keep information longer where required by law, where needed to establish, exercise, or defend legal claims, or where it has been de-identified or aggregated.

8. Security

We use reasonable administrative, technical, and physical measures designed to protect personal information, including encrypted (HTTPS) connections to the Site and access controls on the accounts that hold contact form submissions. However, no website, email system, or method of transmission or storage is completely secure, and we cannot guarantee the security of any information. You provide information at your own risk, and you are responsible for keeping any information you send us through unencrypted channels, such as ordinary email, appropriate for that channel.

9. Your US state privacy rights

Depending on where you live, and subject to the thresholds, exceptions, and limitations in applicable law, residents of certain US states (for example, California, Colorado, Connecticut, Virginia, Texas, Oregon, and other states with comprehensive consumer privacy laws) may have some or all of the following rights, where applicable:

  • Access and portability: to confirm whether we process your personal information and to obtain a copy of it, in a portable format where required;
  • Correction: to correct inaccurate personal information;
  • Deletion: to delete personal information we hold about you;
  • Opt out: to opt out of targeted advertising and of the "sale" or "sharing" of personal information as those terms are defined by law;
  • Appeal: to appeal our decision on your request; and
  • Non-discrimination: not to receive discriminatory treatment for exercising these rights.

We do not use personal information for profiling in furtherance of decisions that produce legal or similarly significant effects, and we do not knowingly collect or process sensitive personal information through the Site.

How to exercise your rights

To make a request, email us at hello@allianceoptimal.com with the subject line "Privacy Request," tell us which right you wish to exercise, and tell us your state of residence. To opt out of targeted advertising or sharing, you may also use the browser-based choices and Global Privacy Control signal described in Section 6.

To protect your information, we will verify your request by matching the information you provide (such as your name and the email address you used to contact us) with the information we hold, and we may ask for additional information reasonably needed to confirm your identity. We will not ask for more information than is necessary. We may decline a request that we cannot verify, that is manifestly unfounded or excessive, or that is subject to an exception under applicable law, and we will explain why.

Where the law allows, you may use an authorized agent to make a request on your behalf. We may require the agent to provide proof of your signed permission and may require you to verify your identity directly with us.

We will respond within the time required by applicable law. If we deny your request, you may appeal by replying to our decision or emailing hello@allianceoptimal.com with the subject line "Privacy Appeal." We will respond to your appeal within the time required by law and, if we deny it, tell you how to contact your state attorney general if the law of your state provides for that.

EEA and UK visitors

If the GDPR or UK GDPR applies to you, you may also have the right to request access to, correction of, or erasure of your personal information, to restrict or object to our processing, to data portability, and to withdraw consent where we rely on consent. You may exercise these rights by emailing hello@allianceoptimal.com. You also have the right to lodge a complaint with the data protection authority where you live or work.

10. International visitors and data transfers

Alliance Optimal is based in the United States, and our service providers may process information in the United States and other countries. If you access the Site from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States and other countries whose data protection laws may differ from those of your country. Where required by law, we rely on appropriate safeguards for such transfers, such as the standard contractual clauses and data processing terms offered by our service providers.

11. Children

The Site is intended for business audiences and is not directed to children under 16. We do not knowingly collect personal information from children under 16. If we learn that we have collected personal information from a child under 16, we will delete it. If you believe a child has provided us with personal information, please contact us at hello@allianceoptimal.com.

12. Links to third-party sites

The Site may contain links to websites and services operated by others, including the opt-out pages listed above. We do not control and are not responsible for the privacy practices of those third parties. Their collection and use of your information is governed by their own privacy policies, which we encourage you to read.

13. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and change the effective date and version number at the top. Changes take effect when posted, unless we state otherwise. If we make a material change to how we use personal information we have already collected, we will take any additional steps required by applicable law, such as providing notice or obtaining consent. Your continued use of the Site after an update is posted means the updated Privacy Policy applies to your use of the Site.
